These Terms and Conditions govern your use of directrealtyteam.com. By using the website, you agree to these terms. If you do not agree, please discontinue use of the website.

Website Information Only

Website content is provided for general informational and marketing purposes. It is not legal, tax, accounting, investment, lending, inspection, engineering, or insurance advice. Property management, brokerage, leasing, buyer representation, seller representation, and other services are governed by separate written agreements.

No Brokerage or Property Management Relationship Created

Viewing the website, submitting a form, sending an email, calling the office, or using a listing search does not by itself create a broker-client, fiduciary, property management, landlord-tenant, agency, or other professional relationship. A relationship is created only through an applicable written agreement signed by authorized parties.

Texas Brokerage Licensing and Supervision

All real estate brokerage activity offered through Direct Realty is conducted through a Texas-licensed real estate brokerage. Brokerage services are performed by Texas-licensed real estate brokers or sales agents acting within the scope of their licenses and under the supervision of the applicable sponsoring or designated Texas real estate broker. Property management, leasing, buyer representation, seller representation, negotiations, and other brokerage services are subject to Texas law, Texas Real Estate Commission requirements, and the applicable written brokerage or management agreement.

Listings, Pricing, and Availability

Property listings, rental availability, MLS information, pricing, fees, dimensions, school information, features, and other details may change without notice and should be independently verified. Properties may be withdrawn, leased, sold, or otherwise become unavailable at any time. Management pricing and service descriptions are summaries; the signed management agreement controls.

Fair Housing and Equal Opportunity

Direct Realty supports the principles of the Fair Housing Act and applicable federal, state, and local fair housing laws. Services and housing opportunities are offered without unlawful discrimination.

Rental Applications, Selection Criteria, and Fees

Do not proceed with this online application unless you have signed a Tenant Selection Criteria.

Applicants must be prepared to pay the application fee. ALL APPLICATION FEES ARE NON-REFUNDABLE. Application fees are charged for processing and screening and will not be refunded because an applicant is approved, denied, withdraws, fails to provide required information, changes plans, or does not move forward, to the extent permitted by law.

In addition to the rental application, each applicant must provide a copy of a valid form of identification and proof of income.

Applicants must provide three years of residential history, contact information for rental references, and complete monthly income information. Most properties require combined gross income of at least three times the monthly rent. Applications that do not contain the required information will not be processed.

Each applicant over the age of 18 must submit a separate rental application and pay a separate application fee. Direct Realty will not run the applications until an application has been received for every applicant in the party.

Pet and Animal Screening

After an application receives written approval, Direct Realty uses a third-party pet and animal policy and screening service. At that stage, all approved applicants must complete the screening process whether or not they have pets or animals at the property. The screening link and instructions will be provided after approval.

Texas Property Code Notice

NOTICE: Pursuant to Texas Property Code Chapter 5, Subchapter H, certain buyers and renters may be prohibited from purchasing real property or entering into leases for one year or more. Buyers and renters who believe these restrictions may apply to them should consult an attorney before entering into the transaction.

Applicant Authorization

Applicant authorizes Landlord’s authorized agent, at any time before, during, or after any tenancy, to:

1. obtain a copy of Applicant’s credit report;
2. obtain a criminal background check related to Applicant and any occupant; and
3. verify any rental or employment history or verify any other information related to the application with persons knowledgeable of such information.

AC Filter Program

TENANTS WILL PAY $20.00 PER MONTH FOR AC FILTER MONTHLY DELIVERY. The applicable lease and addenda control the current delivery or installation schedule and all other program terms.

Submitting an application does not guarantee approval or reserve a property unless confirmed in writing under Direct Realty’s applicable procedures. Resident and owner portals are governed by the platform provider and the applicable lease or management agreement.

Agent Referrals and Client Return Commitment

When a licensed real estate agent refers a property management client to Direct Realty, any referral fee, brokerage relationship, and client-return commitment are governed by the written referral agreement and applicable brokerage requirements. Subject to that agreement, Direct Realty’s intent is to return the referred client to the referring agent when the client later decides to purchase or sell real property. The referring agent must remain properly licensed and affiliated with an eligible brokerage at the time of the future transaction, and any referral or compensation must comply with Texas law and brokerage policy.

MLS and Third-Party Content

The website may include MLS data, AppFolio listings, maps, videos, social media, documents, links, and other third-party content. Direct Realty does not control and is not responsible for third-party websites, availability, security, terms, accuracy, or privacy practices. Third-party trademarks belong to their respective owners.

Acceptable Use

You may not misuse the website, attempt unauthorized access, interfere with operation, introduce malicious code, scrape or reproduce protected content in violation of law, impersonate another person, submit false information, or use the website for unlawful, fraudulent, harassing, or discriminatory purposes.

Intellectual Property

Unless otherwise stated, the website design, branding, text, graphics, photographs, logos, and original materials are owned by or licensed to Direct Realty and are protected by applicable intellectual property laws. Limited personal, noncommercial viewing is permitted. Other reproduction or distribution requires written permission.

Disclaimers

The website is provided on an “as is” and “as available” basis to the extent permitted by law. Direct Realty does not guarantee uninterrupted access, error-free operation, search-engine rankings, listing availability, transaction outcomes, rental income, property condition, applicant approval, or investment performance.

Limitation of Liability

To the fullest extent permitted by law, Direct Realty and its owners, brokers, agents, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from website use, inability to use the website, third-party services, or reliance on general website information.

Indemnification

You agree to indemnify and hold harmless Direct Realty and its representatives from claims, losses, liabilities, and expenses arising from your unlawful misuse of the website, violation of these terms, or infringement of another party’s rights.

Governing Law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute relating solely to website use will be handled in a court of competent jurisdiction in Tarrant County, Texas, unless another written agreement requires a different process or venue.

Changes to These Terms

Direct Realty may update these terms from time to time. Continued use after revised terms are posted constitutes acceptance of the updated terms.
